Fine allegations | Third accuser files sexual abuse lawsuit

A lawsuit accusing Bernie Fine, former Syracuse University associate head men's basketball coach, of sexually abusing then 13-year-old Zach Tomaselli in a hotel was filed by Tomaselli Thursday in Pittsburgh.

Tomaselli now 23, of Lewiston, Maine, is the third man to publicly accuse Fine of sexual abuse. He claims Fine molested him in 2002, when they traveled to Pittsburgh for a Syracuse game.

Fine, who was fired from the university Nov. 27, has not been criminally charged and denies the allegations. Two other men, Bobby Davis, 39, and his stepbrother, Mike Lang, 45, both accused Fine of molesting them in the 1980s and ‘90s when they were ball boys. A fourth accuser has also come forth, but not publicly.

Fine's home in DeWitt was searched Nov. 25 and his Manley Field House office searched Nov. 30.

Tomaselli, who is facing sexual assault charges of his own, said that he would plead guilty to sexually abusing a then 13-year-old boy.

In a statement signed on Wednesday, Tomaselli said he is suing Fine to prevent more boys from being abused. He also said he is getting help, according to the statement.

Tomaselli said in the statement: "I am taking this action to support the other men that have gone public and to do everything I can to protect other kids from harm by Bernie Fine and powerful men like him."

Regardless of whether or not Bernie did anything, in your own words you say "how much pain it causes you". So you knew exactly the pain you were causing. Creating fake accounts to control the kid has nothng to do with anything that happened to you. And I bet Bernie didn't make you buy minors booze and get them drunk either. You can count on one thing. The Judge in Maine can now see what your game is. All this limelight you're giving yourself is not cool. Have some respect for the kid. If I'm wrong regarding you and Fine, I'll apologize, but it's still no reason for the things you did or the "fame" you think you're getting from this. And that's the thing that is so aggravating. Take responsibility and stop making excuses. I was a victim of abuse for a long period of time, and I would never, put another person through that.

You both sound like you know nothing about the case. The reason he probably removed it was because he is not supposed to expose evidence to the media. Must be really hard for him to have proof but not be able to show it. Also he admitted to the abuse he did in Maine and apologized and got better. It was likely a direct consequence from not getting help when Bernie and his Father molested him. Go show your hate somewhere else but leave this poor kid alone. He is a victim and you are re-victimizing him.

I think this guy has some very serious issues. All of the things he does are nothing that a person that was molested would do. His Facebook page is a lesson on inferiority complex and what someone does that has one. This morning he posted "the FBI has proven that I was in Pittsburgh at the time of this abuse and bernie Fines Lawyer will get this information after he's arrested through discovery". A few minutes later he removed it. I guess someone must have told him what the Feds do to liars. As for his supposed "Lawyer", what kind of competant Attorney would file a suit against anyone at the same time admitting they didn't know the facts of the case and had done no investigating against the claims old Zach's records show he was in school during this aleged abuse. A Lawyer has an ethical obligation to make sure of the facts beore filing suit. If you ask me this Lawyer did nothing but use him so he could plug the fact he wants to represent more Penn State victims. Personally, if my child were a victim in the Penn State case, and hearing he doesn't bother to investigate claims prior to filing paperwork, I wouldn't be anywhere near him. He did nothing but use this joker as a means to gain more clients. This entire thing is sickening and the sooner the Feds finish their investigation the better off everyone will be.

Please do a story on how this guy thinks "powerful men" should not abuse young boys, but that it's OK for average men to touch boys' genitals and then make love to Facebook. Put this loser in jail and give the rest of a break from gullible media outlets. Thanks a bunch!
